Terms of Service

These Terms govern the use of SMTP2U, an email sending platform ("SMTP2U", "we", "us"). By creating an account or using the service, you ("Customer") agree to these Terms, to the Privacy Policy and to the Acceptable Use Policy. If you use SMTP2U on behalf of a company, you represent that you have authority to bind it.

1. The service

SMTP2U provides a REST API and an SMTP server for sending transactional and marketing email, together with a dashboard for domains, API keys, contacts, templates, campaigns, automations, webhooks, logs and metrics. Messages are delivered through infrastructure providers engaged by us, such as Amazon SES.

We may evolve, change or discontinue features. Changes that materially reduce the contracted service will be announced with reasonable notice.

2. Account and workspace

  • You must provide accurate information and keep it up to date.
  • Each workspace has an owner, who may invite other people. You are responsible for everything done with the credentials and API keys of your workspace.
  • Keep passwords and keys confidential. If you suspect misuse, revoke the key in the dashboard and let us know.
  • New accounts are reviewed before the first send. We may ask for additional information about your use and refuse accounts that do not meet these Terms.
  • You must be at least 18 years old to create an account.

3. Domains and senders

Email is only accepted from domains that you control and have verified in the dashboard with the DNS records provided. You represent that you have the right to use those domains and the sender addresses you configure.

4. Plans, limits and billing

  • Plans, limits and prices are listed on the Pricing page. Amounts are in United States dollars (USD).
  • The Free plan has a daily and a monthly limit. When either is reached, new sends are refused until the limit resets.
  • Paid plans are monthly subscriptions that renew automatically. On paid plans, emails sent above the monthly allowance are billed as extra emails, at the listed price, on the next invoice.
  • Payments are processed by Stripe. We do not store your card details. Taxes, exchange fees and charges from your card issuer are your responsibility.
  • When you change plans, the difference is charged or credited in proportion to the remaining period.
  • You may cancel the subscription at any time in the dashboard. Cancellation takes effect at the end of the period already paid, and the workspace returns to the Free plan. Amounts already paid are not refunded, except where the law requires it.
  • If a payment fails, we will retry the charge and notify you. If the failure persists, we may suspend sending or move the workspace to the Free plan.
  • We may change prices and allowances with at least 30 days notice. The change applies from the following billing cycle.

5. Acceptable use

Use of SMTP2U is subject to the Acceptable Use Policy, which prohibits spam, purchased lists and unlawful content, and sets bounce and complaint limits. Violations may lead to immediate suspension of sending.

6. Your content and your data

You keep all rights to the message content, templates and contact lists you submit to SMTP2U, and you grant us a limited license to process them solely to provide the service.

With respect to the personal data of your recipients and contacts, you are the controller and SMTP2U is the processor, under applicable data protection law, including the Brazilian General Data Protection Law (Law No. 13,709/2018, "LGPD") and, where it applies, the GDPR. We process that data according to your instructions, expressed through your use of the service, and according to the Privacy Policy. You are responsible for having a legal basis to send your messages and for responding to requests from data subjects.

7. Open and click tracking

SMTP2U records delivery, open and click events. To do so, messages receive an invisible image and links are rewritten to pass through a tracking address operated by our delivery provider. You are responsible for informing your recipients about this tracking where applicable law requires it.

8. Availability and support

We work to keep the service available and secure, but it is provided "as is", without a guarantee of uninterrupted availability, of delivery of every message or of inbox placement, since delivery depends on third-party providers and servers. Current and past availability is published on our status page. Support is provided by email on business days.

9. Suspension and termination

  • We may suspend sending or access immediately in case of violation of these Terms, risk to the reputation of the platform, legal order, fraud or non-payment.
  • You may close your account at any time by requesting deletion at support@smtp2u.com.
  • After closure, workspace data is deleted or anonymized within the periods set in the Privacy Policy, subject to legal retention duties.

10. Intellectual property

The software, brand, dashboard and documentation of SMTP2U belong to us. We grant you a limited, non-exclusive and non-transferable license to use the service while your account is active. You may not copy the service, resell access without authorization, reverse engineer it or circumvent its technical limits.

11. Limitation of liability

To the maximum extent permitted by law, SMTP2U is not liable for lost profits, loss of revenue, data or opportunities, or for indirect damages. Our total liability, for any cause, is limited to the amount you paid to SMTP2U in the 12 months before the event. These limits do not apply in cases of willful misconduct or where the law does not allow the limitation.

You agree to hold us harmless from third-party claims arising from the content you send or from use of the service in breach of these Terms.

12. Changes to these Terms

We may update these Terms. Material changes will be announced by email or in the dashboard with reasonable notice. Continued use of the service after the effective date means you accept the new version.

13. Governing law and contact

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the district where SMTP2U has its registered office have jurisdiction over disputes, without prejudice to the right of consumers to choose the courts of their own domicile.
